2022 · GS Paper 4 · Q2(a) · 10 marks

The Rules and Regulations provided to all the civil servants are same, yet there is difference in the performance. Positive minded officers are able to interpret the Rules and Regulations in favour of the case and achieve success, whereas negative minded officers are unable to achieve goals by interpreting the same Rules and Regulations against the case. Discuss with illustrations.

In short

Officers under identical rules perform differently because a positive mindset reads a rule for its purpose and finds the enabling clause, while a negative one hides behind its letter. Bhilwara's collector used existing powers under the Epidemic Diseases Act, 1897 to build a containment model in 2020.

Introduction
Two collectors under the same Disaster Management Act, 2005 can produce very different outcomes, because a rule is only as good as the mind applying it: some read its purpose, others hide behind its letter.
How a Positive Mindset Turns Rules into Results
•

Purposive reading

Welfare laws are read liberally for their beneficiaries; Bhilwara's collector Rajendra Bhatt used Section 144 and the Epidemic Diseases Act, 1897 for door-to-door screening in 2020, creating a containment model.

•

Firm enforcement

T.N. Seshan applied an existing Model Code of Conduct and Article 324 firmly from 1990 and transformed Indian elections.

•

Preparedness

Odisha used the same disaster framework to evacuate nearly a million people before Cyclone Phailin in 2013, cutting deaths from about 10,000 in 1999 to a few dozen.

Why Negative Minds Read the Same Rules Against the Case
•

Goal displacement

Robert Merton's "bureaucratic personality" (1940) shows rule-following becoming an end in itself.

•

Fear of the 4Cs

Dread of the CBI, CVC, CAG and courts makes officers reject files over minor gaps, which Section 17A of the Prevention of Corruption Act (2018) partly seeks to ease.

•

Limits of positivity

Positive reading never means bending law, as Ashok Khemka's 2012 cancellation of the Skylight-DLF land mutation showed.

Conclusion
Performance differs less because of rules than because of attitude: empathy, ownership and courage let an officer use discretion for the citizen within the law. Training, protection for honest decisions and recognition of initiative can make that mindset the norm.
