2013 · GS Paper 4 · Q13 · 20 marks

As a senior officer in the Finance Ministry, you have access to some confidential and crucial information about policy decisions that the Government is about to announce. These decisions are likely to have far-reaching impact on the housing and construction industry. If the builders have access to this information beforehand, they can make huge profits. One of the builders has done a lot of quality work for the Government and is known to be close to your immediate superior, who asks you to disclose this information to the said builder. (a) What are the options available to you? (b) Evaluate each of these options and choose the option which you would adopt, giving reasons.

In short

I would politely refuse to disclose the policy information, record the superior's request in writing and inform the Secretary and the Chief Vigilance Officer. Leaking it would breach Rule 11 of the CCS (Conduct) Rules, 1964 and the Official Secrets Act, 1923 and hand one builder an unfair windfall.

Introduction
Market-moving policy information is held in trust for the public. The core dilemma is between Hierarchical Loyalty and Official Confidentiality, with Gratitude to a good builder tugging against Impartiality.
(a) Options Available to Me
The request breaches Rule 11 of the CCS (Conduct) Rules and the Official Secrets Act, and favours one firm. I can comply, share a hint, stall, expose at once, or refuse, record and report.
(b) Evaluating Each Option
•

(i) CAPITULATE [Compromised-Hybrid]

Complying pleases the superior but is Moral Myopia with criminal liability.

•

(ii) COMPROMISE [Empathetic-Humanitarian]

A hint rewards the builder but is a Halo Effect; a partial leak is still a leak.

•

(iii) EVADE [Procedural-Evasive]

Stalling avoids conflict but is Moral Escapism; others may leak it.

•

(iv) CONFRONT [Strict-Legal]

Going to the media deters but lacks evidence and breaches the Conduct Rules.

•

(v) RECONCILE ✓ [Balanced]

Refuse politely, record the request and report it (recommended).

(b) Option I Would Adopt, With Reasons
•

Refuse and record

Decline respectfully and note the request, as T.S.R. Subramanian (2013) [case] urged recorded instructions.

•

Report safely

Inform the Secretary and the Chief Vigilance Officer under the CVC's 2004 whistle-blower resolution [scheme].

•

Seal and stay fair

Tighten the embargo and reward the builder only through open tenders, per Nolan's Objectivity [committee/report].

Justification:
Rawls's Difference Principle: enriching one connected builder at others' cost is an unjust inequality.
Conclusion
A respectful refusal on record keeps confidential information a public trust and spares everyone a later scandal.
