2018 · GS Paper 4 · Q8 · 20 marks

As a senior officer in the Ministry, you have access to important policy decisions and upcoming big announcements such as road construction projects before they are notified in the public domain. The Ministry is about to announce a mega road project for which the drawings are already in place. Sufficient care was taken by the planners to make use of the government land with minimum land acquisition from private parties. Compensation rate for private parties was also finalized as per government rules. Care was also taken to minimize deforestation. Once the project is announced, it is expected that there will be a huge spurt in real estate prices in and around that area. Meanwhile, the Minister concerned insists that you realign the road in such a way that it comes closer to his 20 acres farm house. He also suggests that he would facilitate purchase of a big plot of land in your wife's name at the prevailing rate which is very nominal, in and around the proposed mega road project. He also tries to convince you by saying that there is no harm in it as he is buying the land legally. He even promises to supplement your savings in case you do not have sufficient funds to buy the land. However, by the act of realignment, a lot of agricultural land has to be acquired, thereby causing considerable financial burden on the government, and also displacement of the farmers. As if this is not enough, it will involve cutting down of a large number of trees, denuding the area of its green cover. Faced with this situation, what will you do? Critically examine various conflicts of interest and explain what are your responsibilities as a public servant.

In short

I would refuse the realignment and the plot in my wife's name, record the Minister's suggestion and defend the original alignment, as both are clear conflicts of interest. A public servant is a trustee of public money, farmland and forests, loyal to the Constitution.

Introduction
A road drawn to save public land, farms and forests is being bent towards a Minister's farmhouse, with a plot for my wife as the sweetener. The dilemma is between Loyalty to the Political Executive and Public Interest.
Conflicts of Interest in the Case
•

Minister's gain

Realignment would enrich his 20-acre farmhouse, breaching Nolan [committee/report] Selflessness.

•

My gain

A nominally priced, Minister-funded plot in my wife's name is an undue advantage.

•

Legal but unethical

Buying land is legal, but using one's own decision to raise its price is not ethical.

My Responsibilities as a Public Servant
•

Trustee of money and land

Protect the exchequer from avoidable acquisition and farmers from needless displacement, honouring the LARR Act, 2013.

•

Integrity and neutrality

Follow the Conduct Rules on property deals and give frank advice, not private obedience.

What I Will Do
•

Refuse and record

Decline both and note the suggestion on file, as T.S.R. Subramanian (2013) [case] supports.

•

Defend technically

Compare routes on PM Gati Shakti (2021) [scheme] to show cost, displacement and green cover.

•

Escalate if pressed

Inform the Secretary and Chief Vigilance Officer, as Ashok Khemka [officer] recorded pressure in 2012.

Conclusion
I would keep the road where public interest placed it and keep my family out of its windfall, because an officer's loyalty is owed to the Constitution, not to a Minister's private interest.
