2018 · GS Paper 4 · Q2(b) · 10 marks

"The Right to Information Act is not all about citizens' empowerment alone, it essentially redefines the concept of accountability." Discuss.

In short

The RTI Act empowers citizens but, more deeply, redefines accountability as continuous, direct to citizens and personal, through disclosable file notings, proactive disclosure and penalties on officials. Section 20 lets commissions fine a defaulting Public Information Officer up to Rs 25,000.

Introduction
The RTI Act, 2005 grew out of the MKSS's public hearings in Rajasthan and gave statutory form to the Supreme Court's reading of the right to know into Article 19(1)(a). It empowers citizens, but its deeper change is to whom and how the government must answer.
RTI as Citizen Empowerment
•

Information as entitlement

Any citizen can seek records without giving reasons, with replies due in 30 days, or 48 hours where life or liberty is at stake.

•

Voice for the marginalised

Ration-card holders and MGNREGA workers use RTI to trace withheld entitlements, making each an everyday auditor of the State in the spirit of Jan Bhagidari, or people's participation.

How RTI Redefines Accountability
•

Answerable for reasons

Disclosable file notings make officers justify how, not merely what, they decided.

•

Personal liability

Section 20 fines a defaulting PIO up to Rs 25,000, turning secrecy from an institutional habit into a personal cost.

•

No office above it

Subhash Chandra Agarwal (2019) brought the Chief Justice's office under RTI, and RTI applications helped expose the Adarsh Housing scam.

Where the Redefinition Falls Short
•

Weakened watchdogs

The 2019 amendment let the Centre fix commissioners' tenure and pay, while backlogs delay answers.

•

New limits

The DPDP Act, 2023 widened the personal-information exemption, and attacks on RTI users show the cost of asking.

Conclusion
RTI's lasting achievement is to make accountability continuous, horizontal and personal; protecting the commissions and RTI users will decide whether that redefinition endures.
