2023 · GS Paper 4 · Q5(a) · 10 marks

Is conscience a more reliable guide when compared to laws, rules and regulations in the context of ethical decision-making? Discuss.

In short

Conscience is not more reliable on its own: it guides best where law is silent or unjust, while laws and rules ensure equality and check self-serving or conditioned judgement. The reliable guide is a conscience trained by constitutional morality that works through the law.

Introduction
Article 25 guarantees "freedom of conscience", while Article 14 demands a rule of law that treats like cases alike. Conscience is the inner moral sense; laws and rules are external, codified guides enforced by the state.
Where Conscience Proves More Reliable
•

Law is silent or unjust

Rules cannot foresee every situation, and when a law is unjust conscience must speak, as when Gandhi followed his "inner voice" to break the salt law in 1930.

•

Guard against blind obedience

Hannah Arendt's study of Eichmann showed the "banality of evil" in officials who obey lawful orders without reflection.

•

Courage beyond duty

Satyendra Dubey of the NHAI exposed corruption in the Golden Quadrilateral project in 2002 because conscience asked more than the rules did.

Where Laws and Rules Prove More Reliable
•

Conscience can be conditioned

Those who commit honour killings often believe they act rightly, because conscience absorbs the prejudices of caste and community.

•

Equality and predictability

The All India Services (Conduct) Rules, 1968 make decisions uniform, reviewable and equal for every citizen.

•

Democratic legitimacy

Laws carry society's collective conscience through Parliament, and rules force recorded reasons open to audit and RTI, so favouritism cannot pass as compassion.

Conclusion
Neither guide is reliable alone: law is the floor of ethical conduct and an educated conscience its ceiling. The most reliable guide is a conscience trained by constitutional morality, which works through the law and dissents through lawful channels such as the Whistle Blowers Protection Act, 2014.
